WhEREAS, a public sanitary sewer now in operation lies
in an area which served as an alley located north of Delmar
Boulevard and west of Leland Avenue in the City of University City
and said alley was vacated by University City by Ordinance No.
4538 and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
across said sewer easement, and examination and survey of such
sewer and of such building shows that it will not damage the
existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss, or damage from
such encroachment.
The foregoing Resolution was adopted March 11, 1970.
