WHEREAS, there exist within The Metropolitan St. Louis
Sewer District and within the City of St. Louis certain sewers
hereinafter described which are in such condition as to be
acceptable to the District for public operation and maintenances,
and which it is desirable for the District to operate and
maintain, and
WHEREAS, the District by Ordinance No. 88, adopted the
16th day of July, 1956, is authorized to assume title to any or
all sewers, easements, and appurtenances by Resolution whenever,
in the opinion of counsel, no person competent to convey title can
be found, and upon recommendation of the Executive Director that
the District should assume title to such sewers, and
WHEREAS, the General Counsel has given his opinion that
no person can be found who is competent to convey title to the
hereinafter described sewers and the Executive Director recommends
that the District should assume title to such sewers, in that they
form an integral part of the sewer system serving the public,
NOW, THEREFORE, BE IT RESOLVED, that title to the
following described sewers and their appurtenances in the City of
St. Louis be and are hereby assumed by The Metropolitan St. Louis
Sewer District for public use, operation and maintenance as an
integral part of the public sewer system:
1. That sewer lying in the south side of Miller
Street and extending from Third Street to the north-south alley in
City Block 696.
2. That sewer constructed under Permit No. 17160 and
lying in Henrietta Street, and extending westwardly from Ohio
Avenue approximately 370 feet.
3. That sewer constructed under Permit No. 24820 and
lying in the east-west alley in City Block 2147, and extending
from Jefferson Avenue westwardly approximately 300 feet to a
manhole.
4. That sewer constructed under Permit No. 24821 and
lying the east-west alley in City Block 2148, and extending from
Jefferson Avenue westwardly approximately 300 feet to a manhole.
5. That sewer constructed under Permit No. 69682 and
lying in French Market Court, and extending from LaSalle Street
southwardly approximately 200 feet.
6. That sewer constructed under Permit No. 62319 and
lying in 11th Street and extending from the east-west alley in
City Block 469 southwardly a distance of approximately 200 feet.
7. That sewer constructed under Permit No. 45443 and
lying in Broadway, and extending from LaSalle Street to Rutger
Street.
The foregoing Ordinance was adopted July 29, 1970.
