WHEREAS, a public storm sewer now in operation lies in
easements over in the western five (5) feet of Section 1 and the
eastern five (5) feet of Section 2 of Lindbergh-Warson Industrial
Center Addition No. 2 according to the plat thereof recorded in
Plat Book 119, pages 22 and 23 of the St. Louis County Records;
and
WHEREAS, the owner and lessee of the land in which such
sewer lies have requested permission to construct a building
across said sewer easements, and examination and survey of such
sewer and of such building shows that the proposed encroachment
will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easements, provided that the
right of the District to use the easements is preserved and the
District is indemnified against liability, loss, or damage from
such encroachment.
The foregoing Resolution was adopted October 12, 1970.
