WHEREAS, a public storm sewer and public sanitary
sewers now in operation lie in easements in an area bounded on the
North by Maryland Avenue, on the East by Topton Way, on the South
by the property of the Town School District of Clayton and on the
West by Gay Avenue in the City of Clayton, St. Louis County,
Missouri; and
WHEREAS, the owner of the land in which such sewers lie
has requested permission to construct a building across said sewer
easements, and examination and survey of such sewer and of such
building shows that the proposed encroachment will not damage the
existing sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easements, provided that the
right of the District to use the easements is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
