HomeMy Public PortalAboutR1159 R E S O L U T I O N NO. 1159 WHEREAS, there exist within The Metropolitan St. Louis Sewer District and within St. Louis County certain sewers hereinafter described which are in such condition as to be acceptable to the District for public operation and maintenance, and which it is desirable for the District to operate and maintain, and WHEREAS, the District by Ordinance No. 88, adopted the 16th day of July, 1956, is authorized to assume title to any or all sewers, easements and appurtenances by Resolution whenever, in the opinion of counsel, no person competent to convey title can be found, and upon recommendation of the Executive Director that the District should assume title to such sewers, and WHEREAS, the General Counsel has given his opinion that no person can be found who is competent to convey title to the hereinafter described sewers and the Executive Director recommends that the District should assume title to such sewers, NOW, THEREFORE, BE IT RESOLVED, that title to the following described sewers and their appurtenances in St. Louis County be and are hereby assumed by The Metropolitan St. Louis Sewer District for public use, operation and maintenance: 1. That sewer constructed under Permit No. 382 and lying in a 5 foot wide easement over the east 5 feet of Lot 1, Westwood Acres, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 68, page 27 of the St. Louis County Records, and extending from the center of 2 Kappel Drive (50 feet wide), through such easement, and extending approximately 5 feet into a public easement in the south part of the Owen Chambers Subdivision. 2. That sewer constructed under Permit No. 1795 in Oak Tree Haven, Plat 2, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 86, page 25 of the St. Louis County Records, and more particularly described as lying in a 15 foot wide easement over the west 15 feet of Lots 7 through 16, inclusive, and in a 10 foot wide easement over the south 5 feet of Lot 16 and the north 5 feet of Lot 17 of such subdivision, and extending eastwardly to the centerline of Manda Lane (50 feet wide), and thence extending northwardly in said Manda Lane a distance of approximately 50 feet to a manhole. The foregoing Resolution was adopted January 6, 1971.
