WHEREAS, public sewers now in operation lie in an
easement in former Rutger Street, 80 feet wide, between First
Street and Second Street, in the City of St. Louis, Missouri,
which street was vacated by the City of St. Louis by Ordinance No.
55207 reserving an easement for sewer purposes over such former
street, and,
WHEREAS, The Metropolitan St. Louis Sewer District is
successor in title of said easement, and
WHEREAS, the owner of the land in which such sewers lie
has requested permission to permit the encroachment of a building
and appurtenances across said easement and examination and survey
of such sewers and of such structure shows that it will not damage
the existing sewers,
NOW, THEREFORE BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss, or damage from
such encroachment.
The foregoing Resolution was adopted February 3, 1971.
