HomeMy Public PortalAboutR1172 R E S O L U T I O N NO. 1172 WHEREAS, a public sewer now in operation lies in an easement in former Bartle Street, thirty (30) feet wide, between the South line of Papin Street and the North line of an East-West alley, fifteen (15) feet wide, in City Block 3965, in the City of St. Louis, Missouri, which street was vacated by the City of St. Louis by Ordinance No. 51240, and WHEREAS, upon such street vacation The Metropolitan St. Louis Sewer District retained an easement for sewer purposes in said vacated street under its Plan, and WHEREAS, the owner and the lessee of the eastern fifteen (15) feet of former Bartle Street in which such sewer lies have requested permission to permit the encroachment of a building and appurtenances across said easement and examination and survey of such sewer and of such structure shows that it will not damage the existing sewer, NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and he is hereby authorized and directed to license the aforesaid encroachment on said easement, provided that the right of the District to use the easement is preserved and the District is indemnified against liability, loss, or damage from such encroachment. The foregoing Resolution was adopted March 11, 1971.
