WHEREAS, a public storm sewer and sanitary sewer now in
operation lie in easements in a tract of land conveyed to 816
South Kirkwood Road Corporation by deed recorded in Book 6315,
page 174 of the records of St. Louis County, Missouri; and
WHEREAS, the owner of the land in which such sewers lie
has requested permission to construct a building across said sewer
easements, and examination and survey of such sewers and of such
building shows that the proposed encroachment will not damage the
existing sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easements, provided that the
right of the District to use the easements is preserved and the
District is indemnified against liability, loss, or damage from
such encroachment.
The foregoing Resolution was adopted March 24, 1971.
