WHEREAS, a public sewer now in operation lies in an
easement in Out Lot 36 in the City of St. Louis, Missouri, bounded
on the West by the Missouri Pacific Railroad right-of-way, on the
East by Gustine Avenue, and on the North by a line perpendicular
to said railroad right-of-way and two-hundred-eighty (280) feet
North of Gustine Avenue as measured along said railroad right-of-
way, and
WHEREAS, the owner and the lessees of the tract of land
in which such sewer lies have requested permission to permit the
encroachment of a building and appurtenances across said easement
and examination and survey of such sewer and of such structure
shows that it will not damage the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss, or damage from
such encroachment.
The foregoing Resolution was adopted April 22, 1971.
