WHEREAS, public sewers now in operation lie in an
easement in a tract of land in Fractional Section 34, and in U.S.
Survey 2844, and in Lots 11 & 12 of Block 33 of Greenwood
Subdivision, Township 45 North, Range 6 East, Maplewood, St. Louis
County, Missouri; being further described as follows:
Beginning at the intersection of the easterly line of Big Bend
Boulevard with the southerly line of Oxford Avenue; thence
North 79 degrees 44 minutes East along the southerly line of
Oxford Avenue 95.9 feet; thence South 10 degrees 16 minutes
East 61.84 feet; thence South 20 degrees 04 minutes West
along a line 114 feet easterly of and parallel to the
easterly line of Big Bend Boulevard 170.06 feet; thence North
69 degrees 56 minutes West 114 feet to the easterly line of
Big Bend Boulevard; thence North 20 degrees 04 minutes East
175 feet to the point of beginning; and
WHEREAS, the owner and the lessee of the land in which
such sewers lie have requested permission to construct a building
across said sewer easement, and examination and survey of such
sewers and of such building shows that the proposed encroachment
will not damage the existing sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss, or damage from
such encroachment.
The foregoing Resolution was adopted June 17, 1971.
