WHEREAS, a public sanitary sewer now in operation lies
in an easement in a tract of land fronting 127 feet on Ashby Road
and 173.83 feet on Canter Way, in the City of Overland, St. Louis
County, Missouri, and
WHEREAS, the owner and the lessee of the land in which
such sewer lies has requested permission to construct a building
across said sewer easement, and examination and survey of such
sewer and of such building shows that the proposed encroachment
will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted June 17, 1971.
