WHEREAS, a public sewer now in operation lies in an
easement in a tract of land in U.S. Survey 378, Township 45 North,
Range 6 East, St. Louis County, Missouri; bounded on the West by
Big Bend Boulevard, on the South by Millbrook Boulevard, on the
East by a line approximately two hundred eighty-five (285) feet
easterly of and parallel to Big Bend Boulevard, and on the North
by a line approximately three hundred (300) feet North of and
parallel to Millbrook Boulevard, and
WHEREAS, the owner and the lessee of the land in which
such sewer lies have requested permission to construct a building
across said sewer easement, and examination and survey of such
sewer and of such building shows that the proposed encroachment
will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss, or damage from
such encroachment.
The foregoing Resolution was adopted June 30, 1971.
