WHEREAS, a public sewer now in operation lies in an
easement in a former alley, bounded on the West by Lot 19 in Block
9 of Quinmore First Addition, a subdivision of St. Louis County,
Missouri, according to the plat thereof recorded in Plat Book 18,
Page 28 of the St. Louis County Records, and on the East by Lots
25, 26, 27, 28, 29, 30 and 31 in Block 9 of said Quinmore First
Addition, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building across said sewer
easement, and examination and survey of such sewer and of such
building shows that the proposed encroachment will not damage the
existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted September 30, 1971.
