WHEREAS, public sewers now in operation lie in
easements in a tract of land in U.S. Survey 2844, and in Lot 12
and 13 of Block 34 of Greenwood Subdivision, and in that portion
of former Commonwealth Avenue adjacent to said Lots 12 and 13,
Township 45 North, Range 6 East, Maplewood, St. Louis County,
Missouri, and
WHEREAS, the owner of the land in which such sewers lie
has requested permission to construct a building across said sewer
easements, and examination and survey of such sewers and of such
building shows that the proposed encroachment will not damage the
existing sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted September 30, 1971.
