WHEREAS, a public sewer now in operation lies in an
easement within a tract of land bounded on the South by the
northern line of Block 1 of Ramona Park, on the West by Midland
Avenue, on the North by a line two-hundred-seven (207) feet North
of and parallel to the northern line of Block 1 of Ramona Park,
and on the northeast by Carson Road, in the City of Berkeley, St.
Louis County, Missouri; and
WHEREAS, the owner and the lessee of the land in which
such sewer lies have requested permission to construct a building
across said sewer easement, and examination and survey of such
sewer and of such building shows that the proposed encroachment
will not danger the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted May 31, 1972.
