WHEREAS, a public sewer now in operation lies in an
easement in City Block 3948 of the City of St. Louis, Missouri,
bounded on the North by Sarpy Avenue, on the West by the western
block line of City Block 3948, on the South by the eastward
prolongation of Papin Street, and on the East by a line twenty
(20) feet East of and parallel to the western block line of City
Block 3948; and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building across said sewer
easement, and examination and survey of such sewer and of such
building shows that the proposed encroachment will not danger the
existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted July 13, 1972.
