WHEREAS, there exist within The Metropolitan St. Louis
Sewer District and within the City of St. Louis certain sewers
hereinafter described which are in such condition as to be
acceptable to the District for public operation and maintenance,
and which it is desirable for the District to operate and
maintain, and
WHEREAS, the District by Ordinance No. 88, adopted the
16th day of July, 1956, is authorized to assume title to any or
all sewers, easements and appurtenances by resolution whenever, in
the opinion of counsel, no person competent to convey title can be
found, and upon recommendation of the Executive Director that the
District should assume title to such sewers, and
WHEREAS, the General Counsel has given his opinion that
no person can be found who is competent to convey title to the
hereinafter described sewers and the Executive Director recommends
that the District should assume title to such sewers, in that they
form an integral part of the sewer system serving the public,
NOW, THEREFORE, BE IT RESOLVED that title to the
following described sewers and their appurtenances in the City of
St. Louis be and are hereby assumed by The Metropolitan St. Louis
Sewer District for public use, operation and maintenance as an
integral part of the public sewer system:
1. That sewer lying in Portland Terrace and extending
from Broadway westwardly approximately 210 feet, together with an
easement for sewer purposes over the area of said Portland
Terrace.

2. That sewer lying in a five (5) foot wide easement
in City Block 5491 and extending southward from Laura Avenue to
the north-south alley therein.
3. That sewer lying in Theodore Avenue and extending
eastward from a point 200 feet east of the centerline of Mimika
Avenue, a distance of approximately 140 feet.
4. That sewer constructed under Permit No. 95297 and
lying in the east-west alley in City Block 5590 and extending from
Era Avenue to Floy Avenue.
5. Those sewers constructed under Permit No. 85613
and lying in the north-south alley in City Block 5457 and
extending from Johanna Avenue to Lena Avenue, and lying in Lena
Avenue and extending from said north-south alley to Acme Avenue,
and lying in Acme Avenue and extending from the east-west alley in
City Block 5461 to Albertine Avenue, and lying in Albertine Avenue
and extending from Acme Avenue westwardly to the City Limits.
6. That sewer constructed under Permit No. 30358 and
lying in Floy Avenue and extending from Gladys Avenue to North
Pointe Boulevard, and lying in North Pointe Boulevard and
extending from Floy Avenue westwardly to the north-south alley in
City Block 5805.
7. That sewer constructed under Permit No. 34292 and
lying in Mimika Avenue and extending from Gladys Avenue to the
east-west alley in City Block 5804.
8. That sewer constructed under Permit No. 34292 and
lying in Era Avenue and extending from Gladys Avenue to the east-

west alley in City Block 5804, and lying in North Pointe Boulevard
and extending from Era Avenue northwardly approximately 260 feet.
9. That sewer constructed under Permit No. 40553 and
lying in North Pointe Boulevard and extending from Mimika Avenue
westwardly 247 feet. The foregoing Resolution was adopted July 13, 1972.
