HomeMy Public PortalAboutR1295 R E S O L U T I O N NO. 1295 WHEREAS, there exists within The Metropolitan St. Louis Sewer District and within the City of Berkeley, St. Louis County, Missouri, a public sewer within an easement, five (5) feet wide, granted to the Summerleas Corporation, a corporation of the State of Missouri, by deed recorded in Book 2733, Page 622 of the St. Louis County Records, and WHEREAS, the District by Ordinance No. 88, adopted the 16th day of July, 1956, is authorized to assume title to any or all sewers, easements and appurtenances by resolution whenever, in the opinion of counsel, and upon recommendation of the Executive Director that the District should assume title to such sewers, and WHEREAS, the General Counsel has given his opinion and the Executive Director recommends that the District should assume title to such easement, in that it contains a sanitary sewer serving the public, NOW, THEREFORE, BE IT RESOLVED that title to the aforesaid easement in the City of Berkeley, St. Louis County, Missouri, is hereby assumed by The Metropolitan St. Louis Sewer District for public use, as an integral part of the public sewer system. The foregoing Resolution was adopted October 18, 1972.
