A RESOLUTION OF THE LYNWOOD REDEVELOPMENT AGENCY
APPROVING THE SECOND AMENDMENT TO THE HERMILIO FRANCO
DISPOSITION AND DEVELOPMENT AGREEMENT
WHEREAS, the City of Lynwood Redevelopment Agency (hereinafter
"Agency"), a duly organized community redevelopment agency under California
Redevelopment Law, entered into that certain Disposition and Development
Agreement (hereinafter "DDA") with Hermilio Franco (hereinafter "Developer") for
the development of single-family residences within the City of Lynwood; and
WHEREAS, the Agency has determined and that it is in the best interest
of the City of Lynwood and the Agency to amend said DDA; and
WHEREAS, the Agency and the Developer have agreed to amend said
DDA for an extension of twelve (12) months; and
WHEREAS, the Agency also desires to ratify the terms of the original
underlying DDA, the First Amendment to the DDA together with the changes
made by this Second Amendment;
NOW THEREFORE, the City of Lynwood Redevelopment Agency does
hereby resolve as follows:
Section 1. That the Agency does hereby approve the Second Amendment to
the Hermilio Franco DDA attached hereto and does hereby also ratify the terms
of the underlying original DDA and the First Amendment to the DDA, not
expressly modified by this Second Amendment.
Section 2. The Executive Director is hereby authorized to execute said
Second Amendment.
Section 3. This resolution shall go into effect immediately upon its adoption.
