WHEREAS, a public sewer now in operation lies in an
easement in a former north-south alley, 15 feet wide, to the rear
of Lots 1, 2 and 3 in Block 2 of Watsonia Subdivision in the City
of Brentwood, Missouri, which alley was vacated by the City of
Brentwood by Ordinance No. 2054 reserving an easement for sewer
purposes over such former alley, and
WHEREAS, The Metropolitan St. Louis Sewer District is
successor in title of said easement, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
and appurtenances across said easement and examination and survey
of such sewer and of such structure shows that it will not damage
the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted February 15, 1973.
