RESOLUTION authorizing the waiving of claims to any
future percentage increases in grant funding for designated
project C290547 (Bissell Point Sewage Treatment Plant
Modifications) by the Environmental Protection Agency.
WHEREAS, The Metropolitan St. Louis Sewer District has
entered into an agreement with the Environmental Protection Agency
of the United States of America by virtue of an offer made by the
Environmental Protection Agency on October 18, 1972 and accepted
by The Metropolitan St. Louis Sewer District on November 13, 1972,
providing for a federal grant by the Environmental Protection
Agency to The Metropolitan St. Louis Sewer District for the
construction of the Bissell Point Sewage Treatment Plant
Modifications in the sum of Eight Hundred Ninety One Thousand
Fifty Dollars ($891,050.00), which was fifty-five percent (55%) of
the estimated cost ($1,620,000.00) of such improvement; and
WHEREAS, by virtue of the provisions of Public Law 92-
500, the Federal Water Pollution Control Act Amendments of 1972,
the Environmental Protection Agency offer was subsequently
increased by letter dated January 11, 1973 to One Million Two
Hundred Fifteen Thousand Seventy Dollars ($1,215,070.00), which
was seventy five percent (75%) of said estimated cost of such
improvement; and
WHEREAS, The Metropolitan St. Louis Sewer District has
also applied for and received assurance of a supplementary grant
from the Missouri Clean Water Commission; and

WHEREAS, by virtue of the provisions of Public Law 92-
500, the Federal Water Pollution Control Act Amendments of 1972,
The Metropolitan St. Louis Sewer District is entitled to have its
grant from the Environmental Protection Agency increased to
seventy five percent (75%) of the revised project costs
($2,402,100.00), but elects to accept the grant of One Million
Three Hundred Twenty One Thousand One Hundred Fifty Five Dollars
($1,321,155.00), which is fifty five percent (55%) of the revised
eligible cost ($2,402,100), in order not to affect its priorities
with respect to grant funds;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
That The Metropolitan St. Louis Sewer District waives
any present or future claim for any increase in the grant
percentage above fifty five percent (55%) of the revised eligible
costs ($2,402,100.00) from the Environmental Protection Agency for
the said Project No. C290547 consisting of the Bissell Point
Sewage Treatment Plant Modifications. The foregoing Resolution was adopted May 2, 1973.
