WHEREAS, a sewer of a public nature now in operation
lies in an easement in City Block 5636 of the City of St. Louis,
Missouri; subject easement was granted to the City of St. Louis by
deed recorded in Book 7285, Page 336 of the City of St. Louis
records, and
WHEREAS, The Metropolitan St. Louis Sewer District is
successor in title of said easement, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to permit the encroachment of a building
and appurtenances across said easement and examination and survey
of such sewer and of such structure shows that it will not damage
the existing sewer,
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted June 20, 1973.
