WHEREAS, a public sewer now in operation lies in
easements granted to The Metropolitan St. Louis Sewer District by
deed recorded in Book 4507, Page 215 and Book 4733, Page 362 of
the St. Louis County Records, over a tract of land located at
Lemay Ferry and Reavis Barracks Roads, St. Louis County, Missouri;
and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building across said sewer
easement, and examination and survey of such sewer and of such
building shows that the proposed encroachment will not damage the
existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easements, provided that the right
of the District to use the easements is preserved and the District
is indemnified against liability, loss, or damage from such
encroachment.
The foregoing Resolution was adopted September 12, 1973.
