WHEREAS, a public sewer now in operation lies in an
easement in a tract of land in the City of Maplewood, St. Louis
County, Missouri; bounded approximately on the East by Big Bend
Boulevard, on the North by the St. Louis Belt and Terminal
Railroad, on the West by the eastern line of C. S. Rannell's
Subdivision, and on the South by Marshall Avenue, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building across said sewer
easement, and examination and survey of such sewer and of such
building shows that the proposed encroachment will not damage the
existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss, or damage from
such encroachment.
The foregoing Resolution was adopted October 17, 1973.
