WHEREAS, a public sewer now in operation lies in an
easement in a tract of land conveyed to Gene R. Frederic and Peggy
Frederic, his wife, by Deed recorded in Book 6602, page 786 of the
St. Louis County Records, in an area generally bounded on the
north by Manchester Road, on the west by Laclede Station Road
bypass, on the south by Deer Creek and on the west by Breckenridge
Industrial Court, in the City of Brentwood, St. Louis County,
Missouri; and
WHEREAS, the owner and the lessee of the land in which
such sewer lies have requested permission to construct a building
across said sewer easement, and examination and survey of such
sewer and of such building shows that the proposed encroachment
will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss, or damage from such
encroachment.
The foregoing Resolution was adopted December 12, 1973.
