ÁÁ WHEREAS, a public storm sewer now in operation lies in
an easement in Lot 15 of Block 1 in Gardenville Heights, a
subdivision of St. Louis County, Missouri, recorded in Book 7,
Page 84 of the St. Louis County Records; the subject easement
being recorded in Book 4507, Page 211 of the St. Louis County
Records; and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building across said
sewer easement, and examination and survey of such sewer and of
such building shows that the proposed encroachment will not
damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted October 15, 1975.
