R E S O L U T I O N NO. 1443
WHEREAS, a public sewer now in operation lies in an easement
granted to The Metropolitan St. Louis Sewer District by deed recorded in Book
6680, Page 1049 of the St. Louis County Records, over a tract of land in Lot
19, Hanley Industrial Subdivision First Addition, Brentwood, St. Louis County,
Missouri, as recorded in Plat Book 61, Pages 4 & 5 of the St. Louis County
Records, and
WHEREAS, the owner of the land in which such sewer lies has
requested permission to construct a building across said sewer easement and
examination and survey of such sewer and of such building shows that the
proposed encroachment will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and
he is hereby authorized and directed to license the aforesaid encroachment on
easement, provided that the right of the District to use the easement is
preserved and the District is indemnified against liability, loss, or damage
from such encroachment.
The foregoing Resolution was adopted December 10, 1975.
