WHEREAS, the Plan of The Metropolitan St. Louis Sewer
District authorizes the use of special benefit assessments as a
method of paying for the construction, improvement or extension of
sewers; and
WHEREAS, because of the availability of other methods
of financing, the District uses such method but sparingly; and
WHEREAS, St. Louis County and many municipalities
therein have been using federal revenue sharing funds and
community development grants to aid in construction of, primarily,
storm sewers, but would doubtless use such funds as are available
to aid in construction of needed sanitary lateral sewers; and
WHEREAS, by Ordinance No. 3205, adopted March 23, 1977,
the District has called for an election to determine if the voters
of most of the remainder of St. Louis County wish to be annexed to
it, and the Board of Trustees wishes to express its attitude more
formally,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT that the following
policy is hereby adopted:
That the use of special benefit assessments by the
District for construction, improvement or extension of sewers be
abandoned and that the only exception to this doctrine shall be
that when a petition praying for construction of sewers by the use
of special benefit assessments is received by the Board of
Trustees, signed by a majority of the owners of land in the
subject area, who are also the owners of more than one-half of the
land area therein, then the Board may grant the petition and use
such method to pay for such construction. The foregoing Resolution was adopted April 27, 1977.
