WHEREAS, public sewers now in operation lie in an
easement in Lot 32-B of Saint George Resubdivision, a subdivision
recorded in Plat Book 43, Page 74 of the St. Louis County records;
said subdivision being in the Village of Saint George, St. Louis
County, Missouri, and
WHEREAS, the owner and the lessee of the land in which
such sewers lie has requested permission to construct a building
across said sewer easement, and examination and survey of such
sewers and of such building shows that the proposed encroachment
will not damage the existing sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
