WHEREAS, public sewers now in operation lie in an
easement in Lots 12 and 13 of George M. Moore's Subdivision, U.S.
Survey 2502 and 2503, Township 46 North, Range 6 East, Normandy,
St. Louis County, Missouri, and
WHEREAS, the owner of the land in which such sewers lie
has requested permission to construct a retaining wall along said
sewer easement, and examination and survey of such sewers and of
such retaining wall shows that the proposed encroachment will not
damage the existing sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted August 24, 1977.
