WHEREAS, a public storm sewer now in operation lies in
an easement granted to The Metropolitan St. Louis Sewer District
and recorded in Book 5382, Page 88 of the St. Louis County Records
on property described by Deed recorded in Book 1638, Page 562 in
St. Louis County, Missouri; and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building across said
easement, and examination and survey of such sewer and of such
building shows that the proposed encroachment will not damage the
existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on said easement, provided that the
right of the District to use the easement is preserved and the
District is indemnified against liability, loss or damage from
such encroachment.
The foregoing Resolution was adopted November 23, 1977.
