WHEREAS, a public sewer now in operation lies in an
easement granted to The Metropolitan St. Louis Sewer District by
the Plat of Kristal Subdivision, as recorded in Book 149, Page 82
of the St. Louis County records, and
WHEREAS, the owner of a portion of Lot 2 of said
Kristal Subdivision, as recorded in Book 7213, Page 1315 of the
St. Louis County records, in which such sewer lies has requested
permission to construct a building across a portion of said sewer
easement and examination and survey of such sewer and of such
building shows that the proposed encroachment will not damage the
existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted May 14, 1980.
