WHEREAS, a public combined sewer now in operation lies
in City Block 262, in the City of St. Louis, Missouri; and
WHEREAS, the owner of the land in which said sewer lies
has requested permission to construct a building and a fountain
across said sewer in two separate locations, and further wishes to
reroute a portion of said sewer at its own expense; and
examination and survey of said building and fountain show that the
proposed encroachments and rerouting will not damage said sewer;
and
WHEREAS, the owner of the land in which said sewer lies
has agreed to grant to the District a suitable easement for the
rerouting of said sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director and the Secretary-Treasurer are hereby authorized and
directed to license the aforesaid encroachments across said sewer,
provided that the owner of the land in which said sewer lies
grants to the District a suitable easement for the rerouting of
said sewer, and the District is indemnified against liability,
loss or damage from said encroachment.
The foregoing Resolution was adopted November 19, 1980.
