Call to Order and Introduction of Members,Ex-Officio Members and Staff Chairwoman Young calledthe meeting to order at 7:30a.m. and introduced the Board members and staff. Aquorumwas present to hear the items on the agenda. The following members were designated to vote:Graham,Hake,Lacy,Schaeferand Young.Those wishing to speak to the Board were sworn in. 2.Procedures Explained Chairwoman Young explained the proceduresofthe meeting.Mr.Barron entered the following documents as exhibits for all items under consideration at the meeting: 1.The City Code of the Cityof Jefferson,as amended 2.The Comprehensive Plan and Land Use Map 3.Copies of applications under consideration 4. A listof Property owners to whom notice of the hearing was sent 5.The affidavits of publication of notice of the public hearing 6.Copies of drawings and plans under consideration 7.Letters and memoranda from City staff 8.Staff reports and minutes of proceedings 9. Materials submitted by the public or the applicant 3.Adoption of Agenda Mr.Hake moved and Mr.Graham seconded to adopt the agenda as printed.The motion passed 5-0 with the following votes: Aye:Graham,Hake, Lacy,Schaefer,Young 4.Approval of Minutes for the Regular Meeting of November 8,2016 Mr.Hake moved and Ms.Lacy seconded to approve the minutes as corrected. The motion passed 5-0 with the following votes: Aye:Graham,Hake, Lacy,Schaefer,Young The following correction to the November 8, 2016 minuteswas made and noted: BOARD MEMBERS PRESENT ATTENDANCE RECORD Paul Graham 1 of 1 Aye:Graham,Hake, Lacy,Schaefer,Young Minutes/Jefferson City Board of Adjustment Page 2 January 10,2017 5.Communications Received Correspondence was received for Case No.B17001. 6.New Business -Public Hearing Case No.B17001 -1537 Cedar Ridge Place,Unit B;Side Setback Variance.Application filed by James and Susan Rozier,property owners,for a variance of 3 feet from the standard 10 feet side setback to permit a side setback of 7 feet.The purpose of the request is to permit the construction of a roof and screened enclosure around an existing deck.The property is located on the east side of Cedar Ridge Place 300 feet south of Cedar Ridge Road and is described as lot 4 of Cedars Subdivision,Jefferson City,Missouri. Mr.Barron described the proposal and explained that the property owner desires to enclose an existing deck that is located on the side of the unit. He stated that the structure sits at an angle to the property line of the lot, with the closest point of the existing deck being approximately 7.5 feet from the property line. Mr. Barron explained that accessory structures,such as the existing deck, are to be located up to 5 feet from a side property line (if at least 60 feet back from the front lot line). He stated that if the existing deck is enclosed with a roof and screening,it will cease to be an accessory structure and become part of the primary structure,with an applicable side setback of 10 feet.Mr.Barron explained that the property owner has applied for a variance in order to permit the existing deck to be enclosed. Mr.James Rozier,1537B Cedar Ridge Place,spoke regarding this request and explained that they purchased the property in May 2016 and it became apparent that the upper deck was unusable because it faced the south side of the house and got full sunlight.He stated that the lower deck was usable as long as it did not rain.Mr.Rozier explained that their contractor suggested enclosing the deck and adding a roof as well. He stated that they spoke with the affected property owner adjacent to their property and she wrote a letter in support of the proposed project.Mr. Rozier explained that they also spoke with the remaining residents in the neighborhood and no one expressed any concerns.He clarified that their home is owner occupied and there is no homeowners association.Mr.Rozier stated that the proposed enclosure will match the original structure and other townhomes in the neighborhood.He explained that the footprint of the deck will remain the same however the deck will be replaced because of rot. No one spoke in opposition to this request.Correspondence in favor of this request was received from Catherine Hirschvogel,1538-A Cedar Ridge Place. Mr.Barron gave the Planning Division staff report and explained that the required findings appear to be met.He stated that the setback variance is requested in order to screen in and roof an existing deck.Mr.Barron explained that when complete,the deck enclosure would be similar in appearance to enclosed decks attached to other townhomes in the area and the requested variance is for a small portion of the deck that happens to fall within the 10 feet setback area. Mr.Graham commented that the required findings appeared to have been met. Mr.Graham moved and Ms. Lacy seconded to approve the requested variance of 3 feet from the standard 10 feet side setback of the RD district to permit a side setback of 7 feet for the purpose of enclosing an existing deck.The motion passed 5-0 with the following votes: Aye:Graham,Hake,Lacy,Schaefer,Young 7.Miscellaneous Reports. A. Mr.Barron reminded Board members of the retirement reception for Ms.Janice McMillan on Thursday,January 12,2017 from 2:00 pm to 4:00 pm in the Jefferson City Police Department Classroom.
