WHEREAS, a public sanitary sewer now in operation lies
in an easement in Lot 11 of Hickory Hills Plat 4, in the City of
Des Peres, St. Louis County, Missouri, as shown on an "existing
10' wide sewer easement" in said Lot 11, and as recorded in Plat
Book 84, Page 39 of the St. Louis County records; and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a screened enclosure and
deck across a portion of said sewer easement, and examination and
survey of such sewer and of such construction shows that the
proposed encroachment will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted August 24, 1983.
