WHEREAS, a public combined sewer now in operation lies
in vacated rights-of-way of John Avenue between the east line of
East Second Street and the west line of Benedict Avenue, and
WHEREAS, a public combination sewer now in operation
lies in a vacated alley in City Block 2463 (formerly City Block
2465) between the south line of Gano Avenue and the north line of
John Avenue in the City of St. Louis, Missouri, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building across said
sewer, and examination and survey of such sewer and of such
building shows that the proposed encroachment will not damage the
existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment over said combined sewer in vacated
rights-of-way of John Avenue between the east line of East Second
Street and the west line of Benedict Avenue, and further, be it
resolved that the Executive Director be and he is authorized and
directed to license the aforesaid encroachment over said
combination sewer in a vacated alley in City Block 2463 (formerly
City Block 2465) between the south line of Gano Avenue and the
north line of John Avenue in the City of St. Louis, Missouri,
provided that the District is indemnified against liability, loss
or damage from such encroachments.
The foregoing Resolution was adopted September 30, 1983.
