WHEREAS, a public storm sewer now in operation lies in
an easement in Lot 50 of Biscayne Heights Plat No. 10, in the City
of Warson Woods, St. Louis County, Missouri, as shown on a
centerline 10 foot wide easement in said Lot 50, and as recorded
in Plat Book 115, Page 53 of the St. Louis County Records; and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a supplementary solar-
heating greenhouse across a portion of said sewer easement, and
examination and survey of such sewer and of such construction
shows that the proposed encroachment will not damage the existing
sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted October 26, 1983.
