WHEREAS, a public sanitary sewer now in operation lies
in an easement as recorded in Book 6388, Pages 1249 and 1250 in
the City of Hazelwood, St. Louis County, Missouri, and more
particularly as shown on a "10 foot wide easement to M.S.D." in
Lot 3 of Amended Plat of a subdivision of a part of Lot 3 of Menke
Estate Partition in Surveys 147, 148 and 149 of the St. Ferdinand
Common Fields in Township 47 North, Range 6 East, City of
Hazelwood as recorded in Plat Book 132, Pages 76 and 77 of the St.
Louis County Records; and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a building across a portion
of said sewer easement, and examination and survey of such sewer
and of such construction shows that the proposed encroachment will
not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted November 9, 1983.
