WHEREAS, a public sanitary sewer now in operation lies
in an easement in Lot 40 of Page-Link Subdivision, in the City of
Overland, St. Louis County, Missouri, as shown on an existing 10'
wide easement in said Lot 40 and as recorded in Book 3948, Page
486 of the St. Louis County Records; and
WHEREAS, the owner of land in which such sewer lies has
constructed a building across a portion of said sewer easement and
examination and survey of such sewer and of such building shows
that the proposed encroachment will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted June 12, 1985.
