WHEREAS, a public storm sewer now in operation lies in
an easement in Lots 1, 2 and 3 of Salisbury's Addn. to Bremen, in
City Block 1217, City of St. Louis, Missouri, as shown on a 20
foot wide easement in said Lots 1, 2 and 3, and as recorded in
Plat Book 29, Pages 41 and 42 of the City of St. Louis Records;
and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a walk-in freezer across a
portion of said sewer easement, and examination and survey of such
sewer and of such construction shows that the proposed
encroachment will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right of
the District to use the easement is preserved and the District is
indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted July 10, 1985.
