WHEREAS, a public storm sewer and a public sanitary
sewer now in operation lay in two easements in Lot B of Lot 79 of
Iveland Subdivision, in the City of Overland, St. Louis County,
Missouri, as shown on a centerline 10 foot wide easement in said
Lot B of Lot 79 as recorded in Deed Book 7368, Pages 1722 and
1723, and as shown on a centerline of 8" sewer in said Lot B of
Lot 79 as recorded in Deed Book 3910, Page 548 of the St. Louis
County Records; and
WHEREAS, the owner of the land in which such sewers lay
has requested permission to construct a house across a portion of
said sewer easements, and examination and survey of such sewer and
of such construction shows that the proposed encroachment will not
damage the existing sewers;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easements, provided that the right
of the District to use the easements is preserved and the District
is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted July 24, 1985.
