Ã*ÔR E S O L U T I O N NO. 1777•ƒ
ÁÁ WHEREAS, a public sanitary sewer now in operation lies
in an easement in U.S. Survey 2683, Township 46 North, Range 6
East, in St. Louis County, Missouri, as shown on a "20' easement"
in said U.S. Survey 2683, and recorded in Book 6623, Page 2096 of
the St. Louis County Records, and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a retail building across a
portion of said sewer easement, and examination and survey of
such sewer and of such construction shows that the proposed
encroachment will not damage the existing sewer:
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right
of the District to use the easement is preserved and the District
is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted July 23, 1986.
