WHEREAS, a public sanitary sewer now in operation lies
in an easement in Lot 4A of the Resubdivision of Lot 4 of Baxter
Gardens #2, in the City of Hazelwood, St. Louis County, Missouri,
as shown on an existing 10' wide easement in said Lot 4A and as
recorded in Book 5691, Page 207 of the St. Louis County Records;
and
WHEREAS, the owner of land in which such sewer lies has
requested permission to construct a canopy across a portion of
said sewer easement and examination and survey of such sewer and
of such canopy shows that the proposed encroachment will not
damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right
of the District to use the easement is preserved and the District
is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted October 14, 1987.
