WHEREAS, a public sanitary sewer now in operation lies
in an alley in Block 17 of John Priest Subdivision of Block 17 of
Sigerson Nursery Tract, also a tract of land in John G. Priest
Subdivision of Block 17 of Wood and Hart's Subdivision of
Sigerson Nursery Tract, as recorded in Plat Book 8, Page 117 of
the St. Louis City (formerly County) Records.
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a canopy across a portion
of said sewer, and examination and survey of such sewer and of
such construction shows that the proposed encroachment will not
damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment over said sanitary sewer, provided
that the right of the District to use the easement is preserved
and the District is indemnified against liability, loss or damage
from such encroachment.
The foregoing Resolution was adopted October 14, 1987.
