WHEREAS, a public sanitary sewer now in operation lies
in an easement in part of Lot 9 of Bissell Estate Subdivision,
U.S. Survey 112, Township 47 North, Range 7 East in St. Louis
County, Missouri, as shown on a "10 ' easement" in said U.S.
Survey 112, and recorded in Book 6298, Page 933 of the St. Louis
County Records: and
WHEREAS, the owner of the land in which such sewer lies
has requested permission to construct a shopping center across a
portion of said sewer easement, and examination and survey of
such sewer and of such construction shows that the proposed
encroachment will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right
of the District to use the easement is preserved and the District
is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted June 22, 1988.
