WHEREAS, a public sanitary sewer now in operation lies in an
easement in Lot 67 of James S. Thomas Add. in U.S. Survey 2994, St. Louis
County, Missouri, as shown on a "10' wide easement" in said Lot 67, and as
recorded in Deed Book 5597, Pages 470 and 471 of the St. Louis County Records;
and
WHEREAS, the owner of the land in which such sewer lies has
constructed an office/warehouse building across a portion of said sewer
easement, and examination and survey of such sewer and of such construction
shows that the proposed encroachment will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive Director be and
he is hereby authorized and directed to license the aforesaid encroachment on
easement, provided that the right of the District to use the easement is
preserved and the District is indemnified against liability, loss or damage
from such encroachment.
