ÁÁ WHEREAS, a public sanitary sewer now in operation
lies in an easement in Lot 104 of Ridgewood Plat Two, in the City
of Crestwood, St. Louis County, Missouri, as shown on an existing
15' wide easement in said Lot 104 and as recorded in Plat Book
53, Page 45 of the St. Louis County Records; and
WHEREAS, the owner of land in which such sewer lies
has constructed a house addition across a portion of said sewer
easement and examination and survey of such sewer and of such
house addition shows that the proposed encroachment will not
damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right
of the District to use the easement is preserved and the District
is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted March 23, 1990.
