WHEREAS, an easement lies in Lot 35 of Whitehall Court
in Township 45 North, Range 6 East, St. Louis County, Missouri,
as shown as a 10 foot channel easement in said Lot 35, and as
recorded in Plat Book 42, Page 9 of the St. Louis County records;
and
WHEREAS, the owner of the land in which such easement
lies has constructed a house across a portion of said channel
easement, and examination and survey of such easement and of such
construction shows that the proposed encroachment will not damage
the existing easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right
of the District to use the easement is preserved and the District
is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted April 11, 1990.
