WHEREAS, a public storm sewer now in operation lies in
an easement in Block 26 of Carondelet Commons South of River des
Peres, St. Louis County, Missouri, as shown on an existing
easement in Ahepa 53 Manor, as recorded in Book 206, Page 92 of
the St. Louis County Records; and
WHEREAS, the owner of the land in which such sewer lies
wishes to construct a covered walkway and concrete piers across a
portion of said sewer easement, and examination and survey of
such sewer and of such walkway and concrete piers shows that the
proposed encroachment will not damage the existing sewer;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized and directed to license
the aforesaid encroachment on easement, provided that the right
of the District to use the easement is preserved and the District
is indemnified against liability, loss or damage from such
encroachment.
The foregoing Resolution was adopted July 24, 1990.
