WHEREAS, an easement lies in Lot 10 of Westerly Place,
U.S. Survey 412, Township 45 North, Range 4 East, St. Louis
County, Missouri, as shown as a 5 foot easement on the West line
in said Lot 10, and as recorded in Plat Book 302, Pages 18 and 19
of the St. Louis County Records; and
WHEREAS, the owner of the land in which such easement
lies has requested permission to construct a retaining wall
across a portion of said sewer easement, and examination and
survey of such easement and of such construction shows that the
proposed encroachment will not damage the existing easement;
NOW, THEREFORE, BE IT RESOLVED that the Executive
Director be and he is hereby authorized to license the aforesaid
encroachment on easement, provided that the right of the District
to use the easement is preserved and the District is indemnified
against liability, loss or damage from such encroachment.
The foregoing Resolution was adopted April 10, 1991.
